Target Corporate GiftCard Terms & Conditions

These Target Corporate GiftCard Terms & Conditions apply to your purchase, distribution, marketing, use and promotion of Target GiftCards purchased through this Target Corporate GiftCard platform. By accessing or otherwise using this Target Corporate GiftCard platform and/or when you purchase Target GiftCards through this platform, you agree, and are subject, to these Target Corporate GiftCard Terms & Conditions. If at any time you do not accept all of these Target Corporate GiftCard Terms & Conditions, you must immediately stop using this platform.

Target.com Terms & Conditions Also Apply

These Target Corporate GiftCard Terms & Conditions are considered “Additional Terms” under the Target.com Terms & Conditions, and both the Target.com Terms & Conditions [link Target.com Terms & Conditions] and these Target Corporate GiftCard Terms & Conditions apply to your access and use of this Target Corporate GiftCard platform and / or your purchase of Target GiftCards through this platform. If there is a conflict between these Target Corporate GiftCard Terms & Conditions and the Target.com Terms & Conditions, the Target Corporte GiftCard Terms & Conditions govern.

Discounts

Discounts on purchases of Target GiftCards through this Target Corporate GiftCard platform may be available at time of purchase based on method of payment. Please contact the Target Corporate GiftCard team by phone at 1-800-544-3875 for information about availability and process.

Terms Applicable to Target GiftCard End Users

Target GiftCards are solely for use at Target stores, on Target.com and on the Target app. Target GiftCards cannot be used to purchase any prepaid or specialty gift cards. GiftCards are subject to applicable terms and conditions at https://www.target.com/c/target-giftcards-gift-cards/-/N-5xsxt.

Risk of Loss on Orders

In all instances, you have/bear risk of loss to GiftCards (both any value thereon and, where applicable, the physical card) upon delivery of GiftCards to the address designated in your order. 

For GiftCard orders that you designate to be shipped as ‘Activated Cards,’ you have/bear risk of loss upon Target’s tender of the order to the carrier for shipment. 

For GiftCard orders that you do not designate to be shipped as ‘Activated Cards,’ before delivery to the address designated in your order (1) you have/bear risk of loss for GiftCards that are activated by or through you (including, without limitation, by you or the GiftCard end user or by fraud through you or your systems) during shipment, and (2) Target has/bears risk of loss for GiftCards that are not activated by or through you. 

Lost or Stolen Target GiftCard Value

As designated under the “Risk of Loss on Orders” paragraph above, Target bears risk of loss on GiftCards that meet all of the following criteria: (1) have not been delivered to the address designated by you in the order, (2) were not ordered as “Activated Cards,” and (3) were not activated by or through you during shipment. Otherwise, Target is not responsible to replace lost value on activated Target GiftCards that are lost, stolen or fraudulently misused. Activated Target GiftCards are active tender for payment and should be treated and safeguarded like cash. Do not activate your Target GiftCards any earlier than necessary.

Payment by Check

Orders purchased by company check may take up to two (2) weeks to process from the date Target receives the check.

No Resale

You may not resell Target GiftCards (whether through a third party gift exchange website or otherwise), and you may not permit or authorize Target GiftCard end-users to resell Target GiftCards. This prohibition against resale does not, however, apply to the redemption by an end-user of loyalty points or other non-monetary value in exchange for a Target GiftCard.

Returns

Terms for returns in the Target.com Terms & Conditions do not apply to purchases of Target GiftCards through this Target Corporate GiftCard platform. Instead, the following terms for returns apply to purchases of Target GiftCards through this platform: Mobile and electronic Target GiftCards are not returnable. Returns or exchanges of physical Target GiftCards must be made within 90 days of purchase and are subject to a 10% restocking fee unless prohibited by law. Not Redeemable for Cash or Credit

Target GiftCards are not redeemable for cash or credit except where required by applicable law.

Marketing & Promotions

Any and all marketing and promotions that involve Target GiftCards must be undertaken in full compliance with the Licensed Materials Agreement or LMA (add link here and in the webpage footer on the Target Corporate GiftCard platform) and applicable governmental requirements. By creating or logging in to your Target Corporate GiftCard account at this website, you are agreeing to the terms of the current LMA. Target intellectual property may be used in such marketing and promotions only in full compliance with the LMA. You are responsible for any and all costs in connection with such marketing and promotions. Arbitration terms and the Arbitration Agreement in the Target.com Terms & Conditions do not apply to the LMA.

Applicable Law

You agree to comply with all applicable governmental requirements in connection with your purchase, distribution, marketing, use and promotion of Target GiftCards. The transaction between you and Target regarding Target GiftCards, and the terms applicable to such transaction, are governed by the applicable laws of the United States of America and the laws of the State of Minnesota, without regard to Minnesota’s choice of law principles.

Choice of Law, Forum Selection, & Jury Waiver

Except to the extent the Arbitration Agreement section in the Target.com Terms & Conditions applies and provides for different terms, all matters relating to your access to or use of the Target Corporate GiftCard platform and all matters arising out of or related to these Target Corporate GiftCard Terms & Conditions, will be governed by the applicable laws of the United States of America and the laws of the State of Minnesota, without regard to Minnesota’s choice of law principles. Except to the extent (a) the Arbitration Agreement section in the Target.com Terms & Conditions applies and provides for different terms, or (b) you and Target agree otherwise, you agree that any claim or dispute (with the exception of a claim or dispute appropriately lodged in any small claims court in the United States of America) shall be resolved in the United States District Court for the District of Minnesota, and you submit to the personal jurisdiction of that court. If subject matter jurisdiction (including diversity jurisdiction) does not exist in the United States District Court for the District of Minnesota for any such claim, then the exclusive forum and venue for any such action shall be the courts of the State of Minnesota located in Hennepin County, and you submit to the personal jurisdiction of that court. As to any proceeding in court, you and Target both waive your right to a jury trial, unless such waiver is unenforceable.

Modification and Termination

Target may at any time: (i) modify or discontinue any part of this Target Corporate GiftCard platform; (ii) change, modify or waive fees required to use this Target Corporate GiftCard platform; or (iii) offer opportunities to some or all users of this Target Corporate GiftCard platform. Target reserves the right to make changes to these Target Corporate GiftCard Terms & Conditions at any time, and such changes will be effective immediately upon being posted to this platform. Each time you use the Target Corporate GiftCard platform, you should review the current Target Corporate GiftCard Terms & Conditions. You can determine when the Target GiftCard Terms & Conditions were last revised by referring to the “LAST UPDATED” legend at the top of the Target GiftCard Terms & Conditions. Your continued use of the Target Corporate GiftCard platform will indicate your acceptance of the current Target Corporate GiftCard Terms & Conditions; however, any change to the Target Corporate GiftCard Terms & Conditions after your last usage of the Target Corporate GiftCard platform will not be applied retroactively. Target reserves the right, without notice and at its sole discretion, to terminate your account or your use of this Target Corporate GiftCard platform and to block or prevent future access to and use of the Target Corporate GiftCard platform (i) if you violate any of the Target Corporate GiftCard Terms & Conditions, (ii) for any other reason, or (iii) for no reason. Upon such termination, your right to use the Target Corporate GiftCard platform will immediately cease.

You agree that we shall not be liable to you or any third party for any termination of your access to the Target Corporate GiftCard platform. Upon termination, all provisions of these Target Corporate GiftCard Terms & Conditions that are by their nature intended to survive termination shall survive such termination.
